Terms of Service

1. Agreement

These Terms of Service (“Terms”) govern your use of Hyperscale News (hyperscalenews.com), a service owned and operated by JD Key LLC, a Texas limited liability company (“we,” “us,” “our”).

By accessing or using Hyperscale News, you agree to be bound by these Terms. If you do not agree, do not use the service.

2. The Service

Hyperscale News provides daily intelligence briefings covering datacenter development, power infrastructure, and water resources. The service includes:

• Daily email briefings delivered to subscribers
• Web-based briefing archive with full-text access for subscribers
• Limited free access (one free article for verified email users, public access to content after 8 weeks)

3. Accounts

To access subscriber features, you must create an account with a valid email address and password. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. You agree to provide accurate information and to notify us promptly of any unauthorized use.

We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe are being used fraudulently.

4. Subscriptions & Billing

Plans

• Monthly — $59/month, billed monthly
• Annual — $579/year, billed annually
• Team (5 seats) — $1,999/year, billed annually

Trials

Individual plans (Monthly and Annual) include a 7-day trial for $1. A valid payment method is required at signup. If you do not cancel before the trial ends, your subscription will automatically convert to the selected plan at the standard rate.

Recurring Billing

Subscriptions automatically renew at the end of each billing period (monthly or annually) until you cancel. You authorize us to charge your payment method on file for each renewal.

Cancellation

You may cancel your subscription at any time through the billing portal accessible from your account page. Cancellation takes effect at the end of your current billing period — you retain access until then. We do not offer prorated refunds for partial billing periods.

Payment Processing

All payments are processed securely by Stripe. We do not store your credit card information. Stripe's terms and privacy policy apply to payment processing.

5. Intellectual Property

All content published by Hyperscale News — including briefings, analysis, summaries, and original commentary — is the property of JD Key LLC and is protected by copyright.

Subscribers may: Read, share links to, and quote brief excerpts (with attribution) for personal or internal business use.

Subscribers may not: Reproduce, redistribute, or republish full briefings or substantial portions thereof. Systematic downloading, scraping, or automated access is prohibited. Sharing login credentials or forwarding full briefings to non-subscribers is a violation of these Terms.

6. Content & Disclaimers

Hyperscale News provides industry intelligence for informational purposes only. Our briefings draw from publicly available sources and original analysis.

Not professional advice. Nothing in our briefings constitutes legal, financial, investment, or engineering advice. Readers should consult qualified professionals before making business decisions based on our content.

No warranty. We strive for accuracy but do not guarantee that all information is complete, current, or error-free. Content is provided “as is” without warranties of any kind.

Source attribution. Our briefings cite and link to original sources when possible. We respect the intellectual property of the publications we reference.

7. Sponsorship Disclosure

Hyperscale News is sponsored by JD Key Government Affairs, a division of JD Key LLC. Sponsorship does not influence editorial content. All briefings are produced independently based on source material and analysis.

8. Limitation of Liability

To the maximum extent permitted by law, JD Key LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of Hyperscale News. Our total liability for any claim shall not exceed the amount you paid for the service in the 12 months preceding the claim.

9. Modifications

We may update these Terms from time to time. Material changes will be communicated via email to active subscribers at least 30 days before taking effect. Continued use of the service after changes take effect constitutes acceptance of the updated Terms.

10. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles. Any disputes shall be resolved in the courts located in Texas.
