22,000 MW by 2030 Meets the First Moratorium Call

Texas hit 22 GW of datacenter load headed to 2030 and the world's largest construction pipeline, and the first moratorium call from a sitting state official landed the same week. The developers showing up with funded generation, verified water offsets, and counsel already at the table will shape what compliance looks like for everyone behind them.

Texas just took the #1 global data center market title from Northern Virginia, per Cushman & Wakefield, even as Agriculture Commissioner Sid Miller called this week for a statewide moratorium on large data center development pending review of grid, water, and rural impacts. Dallas's rise and the Austin-San Antonio corridor's 5,600 MW under construction sit alongside ERCOT's projection that data centers alone will need 22,000+ MW by 2030.

Power

Self-supplied generation moves from edge case to baseline

SpaceX/xAI signed the White House Ratepayer Protection Pledge on March 4-5, committing $2.8 billion in gas turbines and 1.2 GW of primary generation for Colossus, with signatories assuming full responsibility for grid upgrades including unused capacity. Black Mountain's playbook in Parker County tracks the same logic: Fort Worth Power Core LLC already holds TCEQ air permits for five gas turbines on 2,000+ acres near Weatherford, sequencing generation ahead of the data center decision.

Wood Mackenzie's math explains why. Texas wholesale runs $30-$40/MWh while new gas needs $78-$100/MWh to pencil, the US is adding 4 GW of gas annually against 16.4 GW needed through 2035, and colocation's technical barriers (load-spike damage to turbines, harmonics, sub-synchronous oscillations) make it executable only for the most-capitalized hyperscalers. Risk: developers who can't show funded generation and grid-cost accountability at announcement will lose the speed advantage to those who can.

Water

Closed-loop is becoming the price of admission

Colorado Energy Office director Will Toor put data center water use at roughly 0.1% of Colorado's 6 million acre-feet of annual consumptive use, framing energy, not water, as the real constraint. xAI's Memphis Sand Aquifer plan targets 4.7 billion gallons recycled annually. DCIP Group in DeSoto County, Florida is pitching closed-loop cooling as the entry ticket for its 1,300-acre vision.

The point for Texas isn't that water is small. It's that water-first site selection is what unlocks the political room to build. Risk: Sid Miller's moratorium call and Austin's restriction debate mean developers without verified water offsets at the front of their pitch deck will see permitting timelines stretch while their competitors close.

Politics

The regulatory wave breaks state by state, and Texas is on the list

MultiState counted 300+ state data center bills filed across 30 states in the first six weeks of 2026. Illinois's POWER Act (Sen. Villivalam, Rep. Gabel) would mandate water disclosure and cost absorption. New York lawmakers are pushing a moratorium Governor Hochul has signaled she'll reject, while Stream Data Centers' 500 MW Genesee County proposal draws backlash despite generational municipal payments. Congress is moving too: Hawley-Blumenthal on ratepayer protection, Sanders-AOC on a moratorium, Kaine staking out pragmatist ground.

In Texas, Commissioner Miller's moratorium call and Weatherford's January 2025 zoning prohibition on data centers (which doesn't reach unincorporated Parker County, where Black Mountain assembled its acreage) show the same dynamic playing out under ERCOT and PUCT jurisdiction. Risk: developers who wait for rules to settle will inherit rules written by people who showed up. The ones at the table early shape what compliance looks like.
