The 445 GW Queue Gets a Gate. Capital Commitment Is the New Credential.
ERCOT's batch zero just turned 357 GW of speculative data center load into a capital-commitment test, and AEP Ohio's parallel filter already cleared 24 GW of paper projects off the books. The developers winning the next site cycle are the ones who've already locked generation, signed tenants, and named their water source before announcement.

ERCOT's Technical Advisory Committee voted last week to advance "batch zero," a screening sequence that thins the 445 GW large-load queue through qualification, transmission study, and a financial commitment gate before final interconnection. The first batch won't complete until late 2027. Running parallel: PUC staff want to shift transmission cost allocation for large loads from four coincident peaks to contracted peak capacity, a change that would reshape which project economics actually pencil.
Power
The queue is full, and the screening rules are now the moat.
ERCOT shows 2,000 interconnection projects representing 453,000 MW of potential load, with 357,000 MW from data centers. Senate Bill 6 set the 75 MW threshold; batch zero operationalizes the filter. AEP Ohio's parallel experience is instructive: a binding tariff cratered the speculative queue from 30,000 MW to 5,642 MW of signed commitments. Capital commitment is the new credential.
Developers who front financial commitments and lock generation early will clear the gate. Those waiting to see how the rules settle will discover the studies started without them.

Vertical integration is the answer to interconnection math.
DOE announced a 10 GW Stargate campus at Piketon on a former uranium enrichment site, with 9.2 GW from dedicated natural gas generation and $33.3 billion in Japanese capital. TeraWulf's Lake Mariner is energizing 360 MW in under twelve months on a retired coal site with $290 million in Schneider and Motivair infrastructure and Google-backed Fluidstack as anchor tenant. Applied Digital's $3.6 billion Delta Forge 1 in Rapides Parish locked Cleco supply and closed-loop cooling before announcement.
The common pattern is generation secured, tenant signed, water answered, then announce. Texas developers banking on queue position alone will lose sites to integrated competitors.
Water
Naming your source first is the difference between a permit and a fight.
Cipher Digital's 500 MW Riesel proposal has explicitly ruled out municipal supply but hasn't named a source. Lake Creek Lake holds 10,000 acre-feet annually, but BASF bought those rights in 2021 and Cipher hasn't confirmed availability. Hill County commissioners approved a one-year data center moratorium this month. Meanwhile, Blackstone's QTS Fayetteville facility consumed nearly 30 million gallons without payment, exceeding agreed peak limits during Georgia drought conditions.
Closed-loop cooling pledges only protect developers who can demonstrate them. Water silence at announcement is the vulnerability that organizes opposition before shovels move.
Politics
Other states are writing cost-allocation rules; Texas is still negotiating them.
North Carolina's SB 730 advances three levers at once for facilities above 100 MW: long-term contracts, minimum billing commitments, and a closed-loop cooling mandate. Duke has signed 7.6 GW with 15.4 GW more under negotiation. El Paso adopted a policy direction barring future data center incentives absent a council reversal, after 800-plus participants weighed in and despite the 2023 Meta Chapter 380 rebate generating projected revenue above $1 billion. Kentucky is fast-tracking approvals without a cost-allocation framework at all.
The PUC's 4CP-to-contracted-capacity proposal will determine which Texas loads can afford grid access. Developers who participate in the rulemaking shape rules they can live with. Those who don't will discover the rules weren't written for them.
