Self-Generation, Disclosure, and a 2027 Deadline: Abbott Resets the Terms

Abbott's framework shifts grid costs, water disclosure, and siting authority onto developers themselves, and the projects already pricing it in are pulling ahead. The teams locking generation, groundwater permits, and anchor tenants before announcement will set the 2027 rulemaking; everyone else will inherit it.

Governor Greg Abbott has put the Texas data center industry on notice. His June 10 directive orders the PUCT and ERCOT to shift full interconnection cost recovery onto developers, with regulator recommendations due July 17 and PUCT transmission cost measures by July 31. His 2027 legislative agenda goes further: repeal sales tax exemptions worth roughly $3.3 billion over two years, mandatory water and electricity reporting, closed-loop cooling, and community noise mitigation.

The same week, ERCOT confirmed more than 480 large datacenter interconnection requests totaling 418 GW, nearly five times the all-time peak demand of 85.8 GW. The queue is no longer theoretical, and neither is the political response.

Power

Abbott rewrites the cost-allocation rules; self-generation becomes the template

Abbott's framework forces developers to fund their own grid infrastructure and brings ERCOT's Batch Zero maturity metrics to the front of project planning. The market is already adapting. Blue Energy and GE Vernova are building a 2.5 GW Texas hybrid pairing BWRX-300 SMRs with HA gas turbines, gas online by 2030 while nuclear clears NRC review targeting 2032. KKR's $10 billion Helix platform, with Nvidia and the Kuwait Investment Authority, ties compute buildout directly to Vistra's roughly 50 GW generation footprint.

The developers who lock generation, interconnection position, and anchor tenants before turning dirt will navigate Abbott's cost shift. The ones counting on standard-service offers and historical permissiveness will discover those doors are closing.

Water

Disclosure is the new permit prerequisite

Missouri City passed zoning in May requiring energy and water disclosure before permit approval, with Fort Bend County heading toward 1 million residents. Henderson County commissioners passed a resolution halting data center projects pending impact studies near drought-stage-3 Cedar Creek Lake, where Diode Ventures proposes a facility within 400 yards of the shore. Amazon disclosed 2.5 billion gallons of global 2025 data center water use at 0.03 gallons per kWh, a 52% efficiency improvement since 2021. In Garden City, Kansas, Triple Oak Power is pitching a 6,000-acre project that would use 600 million gallons annually versus 3.2 billion currently used for irrigation on the same land.

The Georgia QTS episode shows the downside: roughly 30 million gallons flowed through unmonitored hookups in Fayette County during drought restrictions. Developers who require verified metering and document offsets before site selection turn water from a veto point into a differentiator.

Politics

County authority gaps drive the action to Austin

Parker County Attorney John Forrest stated plainly at a June 9 meeting that Texas gives counties no statutory authority to regulate data centers. Hood County denied plats and now faces litigation. Hill County's moratorium drew a $100 million lawsuit and was rescinded. Henderson County's resolution requires developer-sourced generation rather than ERCOT draw, mirroring Abbott's direction. The Upper Trinity Groundwater Conservation District's well-permit authority remains the meaningful lever in unincorporated areas.

Ohio just demonstrated where this goes when legislatures act: HB 646 cuts the sales tax exemption from 100% to 50%, requires self-generation above 250 MW, and hands new water rulemaking authority to state agencies. Texas developers who secure groundwater permits first, engage cities and counties before announcement, and treat the 2027 session as a rulemaking opportunity will shape the framework. Those who don't will inherit it.
