Five Mandates, One Deadline: Abbott Hands PUCT the 2027 Blueprint

Abbott's July 17 framework lands while Illinois, Ohio, New York, and Kentucky improvise through moratoriums and frozen incentives, giving Texas developers a defined rulebook competitors elsewhere won't see for months. The package below maps the five mandates against the bring-your-own-power shift and the water disclosure race that's quietly becoming the permitting moat.

Governor Abbott directed the Public Utility Commission of Texas and ERCOT on Wednesday to submit recommendations by July 17 on data center water efficiency, ratepayer cost impacts, and community safeguards, with legislative proposals targeting the 2027 session. The framework would require new data centers to add generation capacity, pay their own interconnection costs, adopt closed-loop water systems, report consumption annually, and would repeal existing sales tax exemptions.

The scale justifies the attention: ERCOT has fielded 500 large-load interconnection requests totaling 418 gigawatts, nearly five times the 85.8 GW summer 2023 peak. The queue's full, and Texas is writing the rules for who gets through it.

Texas Sets the Pace While Other States Improvise

Abbott's framework, repeal sales tax exemptions, mandate developer-funded interconnection, require closed-loop cooling, lands as Illinois paused its Data Center Investment Program effective July 1, Ohio froze new tax exemption requests, Utah's executive order weighs water and ratepayer impacts alongside growth, and New York approved a one-year moratorium on permits for facilities above 20 MW. Kentucky's playbook shows what happens without a framework: Lexington passed a moratorium through October after residents complained they were excluded, and Boyd County's TeraWulf gigawatt proposal sits behind NDAs that left the county judge executive feeling "betrayed."

Texas runs through ERCOT and the PUCT with a defined July 17 deadline. The contrast matters for underwriting. Developers banking on subsidy survival or quiet permitting in either jurisdiction need to rerun their numbers now, because the rules are being written in real time and the ones who participate will shape them.

Power

Bring-Your-Own-Power Goes From Edge Case to Default

The interconnection queue isn't slow, it's full, and the smartest developers stopped waiting. Project Jade in Laramie County lost anchor tenant Crusoe but Tallgrass is still building 2.7 GW of on-site natural gas generation under a bring-your-own-power model, with Black Hills Corp. having already put $200 million into the substation and construction underway. Meta's Socrates project in New Albany pairs with Williams on two off-grid gas plants operational this year. Microsoft recommissioned Three Mile Island for 835 MW coming online 2028. Google signed the first data center virtual power plant deal with Voltus for 100 MW of demand-side relief on PJM.

Senator Tom Cotton's DATA Act of 2026 would exempt off-grid facilities from federal regulation. Each architecture solves the same problem differently: control your generation, control your timeline. Developers still betting on transmission queue position alone are competing for the slowest path to market.

Water

Disclosure Is Becoming the Moat

Amazon disclosed 2.5 billion gallons of AWS water consumption globally last year at 0.12 L/kWh, beating Microsoft's 0.27 L/kWh and what Amazon calculates as an 0.84 L/kWh industry average. Google's Iowa facility alone consumed roughly 1 billion gallons in 2024. Amazon's methodology covers on-site withdrawals, not the upstream power-generation water the IEA estimates is 60% of total footprint. University of Texas researchers project data centers could reach 9% of Texas water consumption by 2040, and two-thirds of new AI builds are landing in America's driest regions.

Utah passed the first statewide transparency law. Abbott's framework would add Texas to that list with annual reporting to the PUC. Developers who publish verified, full-footprint water data before regulators mandate it own the permitting conversation. The ones who don't will explain their methodology to TCEQ and county commissioners who've already read Amazon's numbers.
