Site Control Now Beats a Press Release in ERCOT's Queue

FERC handed six grid operators a federal timeline and a cost-protection backstop Thursday; ERCOT got neither, and that carve-out hands every Texas cost-allocation fight back to developers to solve themselves. The premium just shifted to whoever already holds a cleared interconnect, and the ones who locked generation and cost-recovery terms early aren't waiting on Austin.

ERCOT rewrote the data center queue. On June 18, the Public Utility Commission of Texas approved the Batch Zero framework, a solvency screen forcing projects above 75 MW to prove site control, post nonrefundable fees, and show credible financing before they hold a queue position.

The math demanded it. More than 480 large data centers have applied to connect through 2032, requesting 418 GW, nearly five times the state's all-time peak of 85.5 GW. Applicants learn their status in August 2026, with a final transmission plan targeted for fall 2027. Governor Greg Abbott directed regulators to make data centers fund their own transmission rather than shift costs onto Houston, Dallas, or rural ratepayers. Batch Zero makes that principle structural.

Power

Federal regulators set deadlines everywhere ERCOT isn't.

FERC issued six show-cause orders Thursday directing PJM, MISO, Southwest Power Pool, CAISO, ISO New England, and NYISO to justify or rewrite large-load tariffs within 60 days and file resource adequacy reports within 30. The orders target cost-shifting safeguards, co-location rules, and flexible-load transmission products. Texas is explicitly excluded: ERCOT falls largely outside FERC jurisdiction. Sen. Cynthia Lummis (R-Wyo.) separately introduced legislation clarifying FERC authority over hyperscale interconnections.

That carve-out is the whole story for Texas developers. Other grids now get a federal timeline and a federal cost-protection backstop; ERCOT gets neither. If a Texas project stumbles on cost allocation, there's no FERC cover and no enforcement floor. The grid here isn't slow, it's full, and the fix stays local. Developers who secure generation and lock cost-recovery terms early won't wait on Austin to write rules they didn't help shape.

Power

Capacity moves to whoever already cleared the queue.

Meta signed a reported 1.6 GW capacity agreement with Crusoe across Childress, Texas (tied to Lancium's ERCOT-approved 1 GW interconnect) and Warrenton, Missouri. Crusoe's contracted capacity hit 4.9 GW this month against a 40 GW-plus pipeline. The Childress interconnect matters most: it shows Crusoe cleared transmission sequencing at 1 GW scale in a market with 300-plus GW backlogged. Bitcoin miners already operating Texas power sites hold the same edge under Batch Zero, owning land, interconnection work, and live infrastructure.

Meta isn't betting on fast queue movement; it's buying buildable positions and layering third-party deals (Nebius $27bn, CoreWeave $21bn). Crusoe also walked from a Wyoming project, prioritizing sites with clear transmission paths. The premium now sits on a cleared interconnect, not a press release. Developers without site control, capital, or a real schedule face August as a stress test, not a paperwork date.

Water

El Paso's numbers held; the trust didn't.

At Thursday's City Hall roundtable, El Paso Water CEO John Balliew put Meta's Northeast facility at 400,000 to 500,000 gallons per day, under 1 percent of municipal demand against 108 million gallons supplied daily. That's a clean capacity answer. It didn't close the gap. Residents pressed on noise, health studies, and acoustic barriers; attorney Veronica Carbajal said the community received "no straight answers." Crusoe hit the same wall in Callaway County, Missouri, where 150-plus residents organized against a 1.4-million-gallon-annually cooling estimate, unmoved by golf-course comparisons.

Communities don't litigate water by the gallon; they litigate whether local reserves should absorb new industrial demand. The developers who win answer the noise, health, and transparency questions before operations begin, not after the roundtable. The water math is the easy part. The benefit-sharing case is the work.
