Cost-Causation Is Here. Generation-First Siting Wins the 226 GW Queue.
FERC's June 18 orders put six interstate markets on a 60-day clock to fix large-load pricing, and Abbott's directive lands the same rule inside ERCOT: developers fund the capacity they drive. The ones who win the 226 GW queue arrive with generation secured and water documented, not an interconnection ticket and a hope.

The scale explains the timing. Texas carries 6.5 GW of datacenter capacity under construction, roughly a fifth of the national pipeline, and ERCOT's large-load queue jumped 270% in 2025 to 226 GW, with 73% from datacenters. Cost-causation is now the governing principle in both Austin and Washington.

Cost-causation goes national, and behind-the-meter becomes baseline.
That's why generation-first siting now wins. Bloom Energy (NYSE: BE) jumped 15.27% June 18 on a $2.6B Nebius agreement and an Oracle deal targeting up to 2.8 GW, while SMRs stay years from commercial scale and gas turbines commission in 16 to 30 months. Risk: developers betting on ERCOT interconnection alone now carry transmission-cost exposure they didn't price, and Crusoe's paused 1.8 GW Cheyenne project shows even pre-solved power deals can stall.
Water
Jurisdiction arbitrage is the political tripwire.
Iowa shows the failure mode. Google pivoted from Linn County, which required independent water studies, to annex into the city of Palo, where the ordinance defers to state regulation only. Enseva CEO Doug Sevey called it out publicly. Risk: permissive jurisdictions invite exactly the developer shopping that erodes community trust, and Texas developers who don't specify cooling systems transparently and secure water upfront will watch jurisdictions tighten in response.
