But Abbott's own June 10 conditions are strict, not impossible, and Texas keeps ERCOT and the PUCT as coordinating institutions where fragmented states leave permitting to individual municipalities. Developers who exceed the stated requirements before site selection will shape how the 2027 rules settle. Those waiting for clarity should assume the stricter regime already applies.

Texas lawmakers can't measure what they're regulating
The sequencing gap is the real exposure. PUC officials confirmed the ERCOT interconnection process is "largely technical and focused on electricity needs," so water usage isn't part of that gate. By the time the state wants consumption figures, the footprint is already baked in. Developers who've disclosed water strategy to counties early, or who design around water-light cooling like the Valar Atomics and Nvidia 30 MW nuclear concept in Utah, will clear mandatory reporting faster than operators caught flat-footed.
