"Prove It" Is Now the Price of Admission at the Texas Water District

Diode's Henderson County project stalled on a 2-billion-gallon ask answered with a vague due-diligence line, not cooling and recycling math. Developers who arrive with closed-loop specs and local supply numbers walk in; those treating a fair question as a formality watch the queue close behind them.

Diode Ventures' data center near Tool in Henderson County stalled after the developer failed to justify pulling nearly 2 billion gallons annually from Cedar Creek Lake, owned by the Tarrant Regional Water District. TRWD didn't say no. It said prove it, telling Diode's engineer in March that "the current public sentiment is that data centers are wasteful when it comes to water. Prove that is not the case." Diode never delivered the technical justification, conservation plan, or offset strategy the district requires.

The math drew the scrutiny: Diode sought 5 million gallons per day by year five, escalating toward 20 million eventually, against a Fort Worth citywide draw of 216 million gallons daily in 2025. On July 9, five Fort Worth City Council members requested a moratorium. The water was never the problem. The developer's silence was.

Prove-it is the new price of admission in Texas.

Diode's stall shows how the water question gets answered, or doesn't. TRWD has a published framework: justify usage, submit conservation plans, then talk. Diode skipped straight to the regional authority and offered a vague due-diligence statement instead of cooling efficiency and recycling numbers. Meanwhile Meta's Alberta gigawatt specified closed-loop liquid cooling to cut water draw, and Wärtsilä's analysis flags water scarcity eliminating aeroderivative gas turbine cooling across Mexico and parts of the U.S., narrowing technology choices where power density is already maxed.

The developers who lead with cooling technology, recycling rates, and local supply impact walk through the door. The ones who treat a reasonable question as an inconvenience find the queue closes behind them.

Power

The queue is full, so smart developers build around it.

Two constraints are converging. Transformer lead times now stretch past 160 weeks, more than three years, up from 143 in 2024, per Wood Mackenzie's Ben Boucher. The U.S. interconnection queue held roughly 2,600 GW of pending capacity at end-2025. Wärtsilä calls the result "speed to powerless" and pushes macro-grids of 100+ MW on-site load as bridges to later interconnection, citing a 25% levelized cost edge for reciprocating engines at $86/MWh versus $111/MWh for turbines. Meta's Alberta model runs the same play: the developer funds the Greenlight gas plant and grid upgrades, de-risking the utility.

The race isn't to be first at the substation. Developers who secure transformers and on-site generation early move faster than those betting on conventional grid timing that stretches past 2030.

Politics

Moratoria spread, but code beats the blunt instrument.

Sarasota County commissioners voted 5-0 for a one-year moratorium and directed staff to rewrite zoning so data centers "can't apply," before any binding application arrived. Data Center Watch counted $130 billion in projects blocked or delayed in Q1 2026, with active grassroots groups doubling to 833. Against that, two jurisdictions chose definition over freeze: Wausau's Plan Commission endorsed conditional-use rules requiring water, thermal, sound, and sustainability studies, and a JD Supra analysis argues Pennsylvania's existing curative amendment process delivers what moratoria only promise.

The contrast is the opportunity. Where communities write standards early, prepared developers who arrive with water offsets, anchor tenants, and secured power operate on known ground. Where opposition hardens into outright bans, the capital flows elsewhere. Knowing which is which before land acquisition is the whole game.
