Amazon’s $10 billion Project Eagle campus on nearly 3,000 acres near Boling in Wharton County is the clearest Texas collision this week between hyperscale capital and rural governance gaps. Wharton County Judge Philip Spenrath signed a sweeping NDA with VisionFirst Advisors that limits county release of design, financial, production, and business-plan detail, while residents push public records requests to close the information gap.

Unincorporated Wharton has no zoning authority, and the campus sits about 55 miles southwest of Houston in a county writing few land-use rules as scrutiny rises. Smart operators treat that structure as a site-selection input, not a free pass: locked local books harden opposition even when the check size is large.

Michigan Attorney General Dana Nessel and four environmental groups appealed the Michigan Public Service Commission’s conditional approval of DTE Energy contracts for 1.4 GW to the Stargate campus in Saline Township, the OpenAI, Oracle, and Related Digital project. Nessel’s brief says the commission used ex parte approval without a contested case, and that DTE omitted investment cost categories, withheld standard modeling, and filed heavily redacted contracts that blocked ratepayer-advocate review.

In New Mexico, Transwestern Pipeline (Energy Transfer) slipped the Green Chile lateral’s in-service date from August 15, 2026 to February 1, 2027 after repeated New Mexico State Land Office route rejections and a deeper FERC environmental assessment, pressuring fuel delivery for Oracle’s 2.5 GW Project Jupiter in Doña Ana County. Pennsylvania’s August 15 bulletin separately advanced datacenter-tied gas and backup kit, including Invitium Energy’s Shermans Dale plant notice and an Amazon Salem Township air plan approval covering 84 diesel backup generators.

Fort Worth City Council imposed a 90-day moratorium on new data center approvals, effective once state-mandated steps finish, and tied city sign-off to evidence of ERCOT interconnection approval. Mayor Mattie Parker cast the unanimous vote as alignment with Governor Greg Abbott’s broader pause and stood up a Fort Worth Data Center and Infrastructure Commission, chaired by Dr. Mike Slattery of TCU’s Institute for Environmental Studies, to stress-test noise, water, land-use fit, and zoning.

Black Mountain Energy’s early-April zoning approval sits in unresolved grandfather territory under “new data centers” language. Parker’s office wants commission recommendations ahead of the next legislative calendar, with extension language already in the resolution.

Bottom line: treat Fort Worth ERCOT proof as a municipal critical path and price commission timing into drawdown schedules before the 90-day clock resets.

ERCOT is moving planned verification ahead of interconnection study for Batch Zero large loads after Governor Greg Abbott's Aug. 3 directive, covering up to roughly 250-300 projects and on the order of 200 GW, almost all data centers, over "several months." ERCOT General Counsel Chad Seely said the order puts verification "to the front of the line before we begin the interconnection study process"; while PUCT Chairman Thomas Gleeson framed it as adding certainty to Batch Zero, ERCOT still targets April for Batch Zero study completion and held inclusion notices after the letter.

Octa Data Center Development Company LLC's Aug. 13 comments in PUCT Control No. 59142 translate the same directive for 25-75 MW loads: community-impact filings (noise, light, setbacks, traffic, emergency coordination) without Batch Zero study delay, because Batch Zero still keys off 75 MW aggregate at a single POI. Texas already leads U.S. announced self-supplied data center capacity at 40 GW, and JLL/Morningstar flag that even energized sites with binding utility deals still face curtailment and demand-response exposure when operators control physical flow.

Bottom line: assemble audit-ready ownership, load, and community files now; sub-75 MW and behind-the-meter paths move while large-load study stays gated on verification bandwidth.

Galaxy Digital is staffing a power-systems engineer and former ERCOT transmission modeler so every Texas site is scored on upstream topology, not nameplate “bragawatts,” across a multi-gigawatt platform that includes the operating 1.63 GW Helios campus and a 500-acre McGregor site whose first 74 MW phase only scales after added transmission. In June, large-load interconnection requests reached 438 GW, with data centers about 89% of that stack, as the PUCT green-lit ERCOT’s Batch Zero path for loads 75 MW and up.

Oracle’s Green Chile slip shows the same sequencing risk on the fuel side when route and environmental review lag campus capital.

Bottom line: model substation, contingency, and reinforcement schedules before posting study capital, or budget carrying cost between paper capacity and real energization.

Houston Chronicle reporting puts Project Eagle’s untreated water use near 250 Olympic-sized swimming pools a year, with Amazon pointing to efficiency tech while Wharton publishes little usable consumption detail under the NDA structure. That volume is now a first-pass screen in rural Texas counties that lack zoning but still host resident organizing on resource load.

Fort Worth’s new commission is explicitly charged with water-impact review during the moratorium window, so municipal water findings will start showing up beside ERCOT paper in approval packets. Operators still designing around open assumptions on local supply face redesign and opposition cost when those reviews land.

Bottom line: lock cooling design, source, and offset proof before county or city hearings, or watch water become the veto item after land is tied up.
