Gov. Abbott's Dec. 10 files gate 250-300 projects into the April 2027 study window as Forney and 100 Texas municipalities harden local rules. Operators who complete ERCOT disclosures and lock private generation protect COD; gaps won't clear before a missed batch prices the delay.

Pottawatomie County, Kansas drew 125 to 150 residents to a draft-rules hearing, most seeking a moratorium while state agencies still control power and water. PJM’s five-year strategy, released August 19, names data center load as the growth driver through 2035 but leaves large-load tariff design to a separate FERC Section 206 track. EdgeCore Digital Infrastructure is testing full developer-paid generation, transmission, and delivery cost responsibility across a 1.1 GW Louisa County, Virginia campus and other multi-hundred-MW sites. Capital still prefers jurisdictions that clear power and local process on a calendar operators can underwrite.

UPDATE: December 10 and 17 now price the Texas queue
RFIs run August-September, cure windows through October-November, then the December filings. Chad Seely, ERCOT general counsel and chief compliance officer, said the prior April Batch Zero study target won't hold; the revised interconnection-study date is still open. Medium loads in the 25-75 MW band keep working utility interconnection outside ERCOT's freeze authority, creating a two-tier path.
Bottom line: map every Texas asset to the December 10 response file now; gaps convert to carrying cost through the April 2027 study window and a missed batch measured in quarters.
Water
NEW: Produced-water permits and disclosure are the same clock
A TCU Ralph Lowe Energy Institute panel put the developer problem plainly: claims of “minimal” water use mean little without a baseline, and summer peaks stack industrial draw on residential stress. The audit’s water-source and cooling fields are where that opacity gets priced. Produced-water reuse is a substitution path on paper; cost, logistics, and unfinished pilot science still gate real volumes.
Bottom line: operators without named water sources, cooling tech, and summer-demand timing in the ERCOT file will defend community terms with empty fields when December verification lands.
Power
CONTEXT: Self-supplied power is the live path around the freeze
Nationally, EdgeCore says it will fund generation, transmission, and delivery for campuses including 1.1 GW in Virginia, 496 MW in Mesa, and 216 MW in Reno, and signed the White House Ratepayer Protection Pledge. Tariff design still decides which upstream system costs stick to the load. Transmission position before site selection remains the sequence that protects energization dates.
Bottom line: treat secured private generation and a complete audit response as co-equal path items; queue place without both is optionality, not a COD.

A June 2026 Echelon survey found 62% of voters opposed to a local AI data center (58% after pro-growth messaging), with opposition spanning parties on bills, water, noise, and jobs. Oracle’s 2.45 GW Project Jupiter charm offensive in Doña Ana County, New Mexico shows local sponsorship doesn’t clear a state-level freeze.
Bottom line: underwrite nine-to-twelve-month local process, map home-rule versus county limits parcel by parcel, and file audit disclosures that answer noise, light, water, and ownership before ordinances harden around the site.
