Virginia Led. Now New Jersey and Illinois Want Hyperscalers to Pay the Grid Bill.

Virginia's three-bill package has spawned copycats: New Jersey's S-680 and Illinois' POWER Act both run on the same cost-internalization logic, and JLARC's projection of $14 to $37 monthly residential rate increases by 2040 is the number Trenton and Springfield legislators are citing. Developers who've treated Virginia as a one-state outlier now face a regional framework taking shape across PJM in real time.

The 2026 General Assembly passed three bills that shift grid upgrade costs onto data centers (SB 253), mandate water utility reporting of datacenter consumption (SB 553), and require site impact assessments for facilities exceeding 100 MW (SB 94/HB 153). With $80 billion in datacenter investment already in Virginia and a JLARC projection of $14 to $37 monthly residential rate increases by 2040, the legislation represents the most complete state-level attempt to make hyperscalers internalize their infrastructure footprint. The Moratorium Wave Is Accelerating, and It's Not Just NIMBYs

Four states now have active or pending datacenter moratoriums, and the pattern is unmistakable. Apex, North Carolina voted unanimously March 10 to draft a one-year moratorium; Chatham County, Gates County, and Canton, NC already passed theirs. Monterey Park, California froze applications after adopting CEQA-style environmental review mandates that killed HMC StratCap's $400 million Saturn Business Park project mid-transaction. Gary, Indiana council members are publicly questioning deals before any formal proposal arrives.

The common thread is the absence of local ordinances. Apex Mayor Pro Tem Terry Mahaffey said plainly: "Apex doesn't have any rules about data centers in our ordinances." Developers who arrive before the rules exist are handing opponents the narrative.

Norwalk, Iowa offers the counterexample. Its council approved Tract's $12 billion, 282-acre campus with zero tax incentives requested, $5 million annually to the city, and Tract funding $8.2 million in water and street infrastructure upfront. The difference: council engaged preemptively, addressed rate and water concerns on the record, and cited positive feedback from neighboring Iowa communities with operating facilities.

Bottom line: developers who bring community benefit-sharing models and infrastructure cost commitments to the table before local opposition organizes will close deals; those who don't will watch moratoriums proliferate.

Cost-Shifting Bills Are Converging Across PJM and the Midwest

Virginia's SB 253 has company. New Jersey's Senate Environment and Energy Committee advanced S-680, mandating new datacenters source 100% of electricity from renewables or nuclear, with a regional trigger requiring majority adoption across 12 PJM states before enforcement. Illinois legislators introduced the POWER Act, requiring datacenters to pay all energy infrastructure costs, obtain water permits, and meet efficiency standards. The Union for Concerned Scientists projects datacenters could add $24 to $37 billion in electricity system costs nationally by 2050.

The political logic is identical everywhere: residential ratepayers won't absorb hyperscaler grid costs. NJ Sen. Bob Smith's framing is blunt: "Bring your own electricity with you." Illinois has already granted $983 million in lifetime tax breaks to at least 27 datacenters, creating political pressure to claw back cost advantages.

For Texas operators, this is a competitive gift. Every state that layers cost-internalization mandates pushes marginal projects toward jurisdictions without them. But it's also a warning: if the "fair share" narrative reaches Austin, prepared developers who've already committed to behind-the-meter generation and community infrastructure funding will shape the rules rather than react to them.

Behind-the-Meter Gas Is Becoming the Default Hyperscaler Strategy

The five largest tech companies are projected to spend $700 billion on infrastructure in fiscal 2026, up from a September estimate of $465 billion. Increasingly, that capital bypasses the grid entirely. Natural gas turbines deployable in 2-4 years are winning over multi-year grid upgrade timelines, according to ETF Trends analysis. Most planned U.S. datacenter capacity clusters near existing gas networks, with Texas as the geographic center of gravity.

ArcLight Capital Partners is acquiring a 50% stake in Invenergy's 5.4 GW thermal power portfolio across seven North American markets. ArcLight president Angelo Acconcia framed the investment explicitly around "AI and electrification demand." Meanwhile, Xcel Energy doubled its contracted datacenter pipeline to 6 GW by end-2027 and landed a $1.5 billion 765-kV transmission line in the Southwest Power Pool.

The transmission math remains brutal: only 322 miles of 345 kV+ lines were built in 2024 against a DOE target of roughly 5,000 miles annually. That gap is why behind-the-meter is winning.

Bottom line: the shift from grid-dependent to self-powered models reduces state permitting leverage and utility revenue visibility while concentrating power security in private hands. Grid operators who can't offer competitive interconnection timelines will lose load to BTM permanently.
