Communities Aren't Anti-Datacenter. They're Anti-Surprise.

Rep. Helen Kerwin's moratorium letter to Governor Abbott names the exact gap driving community backlash: Texas has no statewide water consumption or grid impact standards for hyperscale facilities, even as projected demand hits 161 billion gallons annually by 2030. Developers who arrive with credible, community-vetted water strategies before permits are filed will move; those who don't will hand opponents the narrative, as Sailfish already learned in Hood County.

Sailfish's 2,100-acre Comanche Circle campus near Tolar illustrates the bind. Developer Ryan Hughes says closed-loop cooling would consume ~50,000 gallons per day at full buildout, but he initially pursued a surface water MOU with Somervell County Water District to avoid groundwater reliance. Public opposition killed that deal, pushing the project toward the very groundwater dependency residents feared. Sailfish is now exploring treated municipal wastewater as an alternative.

Meanwhile, Arizona's experience offers a useful comparison. A 2025 Ceres analysis found Phoenix-area datacenter water use at 385 million gallons annually, representing less than 0.5% of regional total consumption, with agriculture consuming over 70% statewide. The contrast matters: measured industrial water data in Arizona contradicts worst-case forecasts, but corporate opacity around actual usage figures keeps political pressure alive.

Bottom line: developers who can't articulate a credible, community-accepted water strategy before permits are filed will hand opponents the narrative. The Sailfish reversal is a cautionary template.

Moratorium Pressure Spreads Across State Lines

Kerwin's Texas moratorium call isn't isolated. PennFuture is pushing Pennsylvania lawmakers for a statewide development pause, citing over 20 proposed hyperscale facilities that outpace existing permitting frameworks. In Wisconsin, 400+ residents packed a Juneau town hall over Meta's Beaver Dam expansion, where two southeastern Wisconsin projects alone have requested nearly 4 GW, more power than all Wisconsin households currently consume.

The common thread across all three states: communities want transparency, cost protection, and input before infrastructure decisions are locked in. Enforceable state tariff frameworks are emerging as the real policy mechanism. Latitude Media's analysis found 25 datacenter-specific utility tariffs across 19 states, with 18 filed or approved in 2024-2025, featuring billing floors averaging ~80% of contracted demand and collateral requirements reaching $1.5 million per MW in Dominion Energy Virginia's territory.

Texas, notably, lacks a published datacenter-specific tariff, relying instead on legislation and individual contracts. Could community pressure from districts like Kerwin's accelerate that?

Bottom line: the White House pledge has no audit mechanism or enforcement. State tariffs with binding floors and collateral requirements are where accountability lives, and developers who engage in rulemaking now will shape those terms.

Fermi America Bets Big on Panhandle, Iron Mountain Enters Texas

Fermi America plans to file a second 5 GW clean air permit with TCEQ for Project Matador near Amarillo, scaling the campus to roughly 17 GW total: 11 GW natural gas, 4.4 GW nuclear, plus solar and battery. TCEQ already approved the first 6 GW permit. The nuclear component is the wildcard: Fermi hasn't named a reactor partner, disclosed NRC pre-approval status, or detailed water rights in the Panhandle's stressed Ogallala Aquifer region. If nuclear slips, this becomes a pure gas play.

Separately, Iron Mountain is planning its first Texas datacenter: a seven-building, 500-acre campus called Taylor Meadows near Hutto in Williamson County, targeting grid connection around 2030 with behind-the-meter natural gas generation as a bridge. Samsung's nearby Taylor semiconductor fab creates shared infrastructure potential but also competing load risk.

What could derail these timelines? Fermi's nuclear ambitions face multi-year NRC permitting realities no air permit can shortcut. Iron Mountain's 2030 grid target assumes ERCOT interconnection queue movement that most Texas campus builds have missed by 18-24 months.

Southeast Utilities May Be Overbuilding by 45-65%

New modeling from Greenlink Analytics and Science for Georgia, presented by the Southern Environmental Law Center, finds that utilities across Alabama, Georgia, and the Carolinas are planning ~10 GW of new generation for datacenter demand that independent analysis projects at 3.5-5.5 GW. Georgia Power's own pipeline flashed warnings: more than half the projects in its 2023 Integrated Resource Plan disappeared, yet the Georgia Public Service Commission approved nearly 10 GW of new capacity in December 2025.

A structural conflict amplifies the risk: Southern Company holds co-ownership stakes in proposed gas infrastructure, including the SSE4 methane pipeline, creating incentive to overestimate demand across multiple revenue streams while ratepayers absorb the cost.

Bottom line: Texas developers watching Southeast capacity buildout should track whether stranded asset litigation emerges. If it does, expect PUCT and state legislatures everywhere to tighten demand verification requirements for utility resource plans.
