Texas Writes the Rules While Google Writes the Check

Google is financing a $5 billion-plus Nexus Data Centers campus for Anthropic in Texas, with 7.7 gigawatts of expansion potential powered by dedicated on-site gas generation, while Lt. Gov. Dan Patrick has simultaneously launched three Senate committee investigations into data center water use, electricity demand, and sales tax exemptions. The developers who show up to those interim hearings will help write the rules; the ones who don't will live by them.

Google is backing a $5 billion-plus data center campus in Texas for Anthropic through Nexus Data Centers, a deal that redefines hyperscaler involvement in infrastructure finance. The 2,800-acre site plans 500 megawatts online by late 2026, with expansion potential to 7.7 gigawatts, powered by dedicated gas-fired generation near Energy Transfer and Atmos Energy pipelines. Simultaneously, Microsoft is building two new AI buildings and a 900-megawatt power plant in Abilene after OpenAI backed away from further expansion there, consolidating Texas's position as the epicenter of American AI infrastructure.

These moves land as Lt. Gov. Dan Patrick has directed three separate Senate committee investigations into data center water use, electricity demand, and the fiscal cost of sales tax exemptions, signaling that Texas policymakers intend to shape the rules governing this buildout. Developers who engage early in that process will help write them.

Power

Behind-the-meter generation becomes the default playbook for gigawatt-scale AI.

Google's Nexus campus, Microsoft's 900-megawatt Abilene plant, and roughly 50 gigawatts of behind-the-meter capacity announced industry-wide in 2025 confirm that on-site gas generation is the bridge strategy for hyperscale AI. Microsoft's new plant dwarfs the existing 350-megawatt facility serving OpenAI and Oracle on the same Abilene tract. Crusoe is executing both the OpenAI and Microsoft builds, bringing the campus to ten structures and a projected 2.1 gigawatts of computing power. ERCOT has estimated data center load could hit 78 gigawatts by 2031, roughly 36% of state electricity demand.

Moody's analyst Jim Hempstead frames the constraint plainly: power, not chips, is the bottleneck keeping AI capacity constrained through at least 2027. Six hyperscalers will spend roughly $700 billion on capex this year, an 81% increase over last year. But that spending is eroding free cash flow and forcing higher debt issuance. Moody's has downgraded the outlook on two hyperscalers. Risk: behind-the-meter gas generation eases interconnection delays but doesn't eliminate fuel supply constraints. If credit conditions tighten and grid interconnection timelines don't improve, the bridge strategy could become a permanent cost burden.

Water

El Paso becomes the test case for data center water politics in Texas.

Meta's El Paso project expansion from $1.5 billion to $10 billion is triggering real political consequences. El Paso Electric's PUC filings reveal a $473 million gas-fired power plant whose costs will eventually shift to all ratepayers after a one-to-five-year bridge period where Meta covers delivery costs. The data center will consume 400,000 gallons daily from a municipal system distributing 110 million gallons. District 8 City Rep. Chris Canales has publicly reversed his support for the project's incentive package, and community meetings are scheduled through April 8.

Meta is responding with 200% water restoration commitments, farmer irrigation projects, a $500,000 workforce training grant, and $25,000 in water bill assistance. But a fundamental tension remains unresolved: Meta claims 100% renewable energy coverage at its expense, while El Paso Electric is building a natural gas plant specifically to power the facility. That misalignment needs resolution before construction phases complete. Risk: political momentum is hardening against the project. If El Paso becomes a cautionary tale, other Texas communities will scrutinize water-intensive developments more aggressively, particularly with Patrick's Water, Agriculture and Rural Affairs Committee now charged with assessing data center water demands.

Politics

Texas legislative scrutiny creates a window for developers who show up.

Patrick's interim charges span three committees: water demands, electricity impacts balanced against property rights and community integrity, and the fiscal cost of sales tax exemptions. House Speaker Dustin Burrows announced aligned priorities, signaling a coordinated two-chamber approach. This is the moment for sophisticated developers to participate in interim hearings, provide data, and help shape rules before they're written.

Beyond Texas, the pattern is national. In Wisconsin, MISO reversed a $1.3 billion competitive transmission award from low-bidder Viridon to incumbent ATC, citing construction urgency driven by a $15 billion data center campus in Port Washington. In West Virginia, Fundamental Data's contested Tucker County project faces a pending lawsuit and only disclosed 1.3 GW of solar plans after U.S. senators applied pressure. Risk: developers who treat regulatory engagement as optional will find rules written without their input. The interim study process in Texas, MISO's transmission selection criteria, and West Virginia's permitting friction all reward those who engage early and substantively.

Power

Execution capability is the new competitive moat.

DPR Construction's Christopher Gorthy identifies labor retention and early stakeholder coordination as the critical separators for on-time delivery. DPR maintains 5,000+ skilled craft employees with in-house prefab capabilities and is investing in proprietary apprenticeship programs in the Southeast and Texas. iMasons' Miranda Gardiner reinforces the point: more digital infrastructure will come online in the next five years than in the past 30 combined. Organizations delivering multiple large-scale facilities simultaneously across regions will win. Those relying on transactional vendor relationships will eat delays.

Endeavour's launch of Pact Systems, a methane-cracking hydrogen production technology with saleable graphite as a byproduct, adds another execution variable. The system targets on-site hydrogen fuel for AI campuses while eliminating atmospheric carbon release. Risk: labor scarcity and coordination failures will delay projects regardless of capital availability. Developers without workforce strategies and supply chain partnerships locked in now will find themselves outpaced by those who built those relationships early.
