ERCOT's Queue Is Separating Real Developers From the Rest

Texas holds 410,000 MW of datacenter demand in ERCOT's queue while five other states vote on moratoriums, and ERCOT's batch interconnection process is becoming the de facto national sorting mechanism. Developers with dedicated generation and deposit-ready commitments are inheriting the market; everyone else is handing opponents the argument.

Texas is now the epicenter of the global data center buildout, and ERCOT's grid planning framework is cracking under the weight. CEO Pablo Vegas told the House Committee on State Affairs that 410,000 megawatts of data center demand sit in the interconnection queue, 87% of all incoming requests, roughly seven times the growth ERCOT managed just two years ago. Vegas acknowledged the grid operator has never held transmission capacity for projects, and that era is ending.

ERCOT is designing a "batch interconnection process" to rank projects, collect deposits, and reserve transmission capacity before construction begins. But lawmakers are already pushing back on cost surprises: State Reps. Charlie Geren and McQueeny flagged a constituent who received six days' notice for a $24 million charge on top of $6 million already committed. PUC Chair Thomas Gleeson committed to investigating. The rules aren't written yet, and the window to shape them is closing fast.

Power

Capital flows confirm Texas as the world's next largest datacenter market.

Synergy Research Group data shows Texas and the Midwest operate 33% of U.S. hyperscale capacity today but will capture 53% of all new capacity coming online over the next several years. JLL forecasts Texas will become the world's largest datacenter market by 2030. Amazon, Google, Meta, Microsoft, OpenAI, and Coreweave are all redirecting capital inland, drawn by ERCOT's deregulated market structure, below-average electricity costs, and faster commercial contracting. Synergy's John Dinsdale noted the emergence of "gigawatt-scale campuses" in places like Abilene and Mount Pleasant.

The flip side of that capital surge is the 410 GW queue. Ed Hirs, oil and gas expert, put it plainly: "There's no way that they'll be able to join the group without bringing some amount of their own electricity." ERCOT's new interconnection fee structure is designed to separate committed applicants from tire-kickers, but developers who haven't secured dedicated generation or long-term PPAs before filing will face delays or rejection. The risk: if ERCOT's batch process timeline slips past the next legislative session, cost allocation disputes and retroactive charges could freeze early movers in place.

Water

The industry's credibility gap on water is widening, from Memphis to Arizona.

xAI has indefinitely paused construction of the wastewater recycling plant at its Memphis Colossus data center, the facility Elon Musk's team had positioned as the cornerstone of its water strategy. Without it, the operation could extract billions of gallons annually from the Memphis aquifer. The company says plans "have not changed," but "indefinitely paused" and "committed" don't belong in the same sentence. In Arizona, Project Blue's $5 billion Pima County campus collapsed after grassroots opposition over water consumption equivalent to four golf courses forced officials to deny land use changes. Amazon withdrew in December. Industry participants acknowledge the saga "poisoned the well" for near-term Tucson development.

The pattern is national. Google's Oregon facility consumed 29% of The Dalles' total water in 2021. In Newton County, Georgia, residents near a Meta data center reported wells running dry. A medium-sized facility consumes 1 million gallons on peak days; larger ones hit 8 million. Stewart Title VP Brian Chen crystallized the constraint at Bisnow's DICE Southwest conference: "You can bring generators to create power, but you can't make water." Developers entering water-stressed markets without binding consumption caps, recycling infrastructure on firm timelines, and transparent aquifer impact data face project-killing opposition. The risk compounds in Texas, where water-stressed regions overlap with the state's hottest site selection corridors.

Politics

Moratoriums are spreading, and the transparency deficit is the accelerant.

Maine's House passed a temporary moratorium on large data centers with bipartisan support. Similar bans are advancing in New York, South Carolina, Oklahoma, and Vermont. Data Center Watch reports community opposition has blocked or delayed over $60 billion in investment in just over a year. The Data Center Coalition warned state moratoriums "send a signal that the state is closed for business." South Carolina Rep. Steven Long, a Republican cosponsor, captured the dynamic: "The public policy hasn't been able to keep up with it."

The common thread across opposition movements, from Conewago Township, Pennsylvania (100+ residents at a hearing over a 541-acre zoning amendment) to Columbus, Georgia (Project Ruby's undisclosed end user fueling organized resistance) to Wisconsin ($2.6-2.98 billion in transmission costs triggering ratepayer advocacy), is a transparency gap. Developers who withhold project details, end users, water consumption projections, cost allocation structures, hand opponents their strongest weapon. Texas showed no appetite for moratoriums at last week's hearing, but the national pattern is unmistakable. Developers who engage early, disclose specifics, and build benefit-sharing frameworks will operate in states that write rules rather than bans. Those who don't will find the regulatory window shutting before they can get through it.
