Engage Early or Inherit Someone Else's Moratorium

Community opposition has killed $18B in projects and stalled $46B more across 24 states, and Maine's new moratorium blocking facilities over 20MW means every jurisdiction without clear rules is now a live political target. Texas isn't one of them, and that gap's widening fast.

Community opposition has become the single largest non-technical risk to data center development in America. Data Center Watch reports $18 billion in projects canceled and $46 billion delayed over two years, with 142 activist groups across 24 states now actively blocking construction. Maine this week became the first state to pass a statewide moratorium on large data centers (LD 307, blocking facilities over 20 MW through at least October 2027), Virginia's appeals court just invalidated the Digital Gateway rezoning, and Kentucky's ratepayer protection bill died on the last day of session after utility opposition killed it.

The pattern is unmistakable: jurisdictions without clear regulatory frameworks are slamming the brakes. Developers who engage communities early, structure benefit-sharing agreements, and help shape rules before they harden will move while competitors stall.

Politics

Moratoriums, court losses, and legislative failures signal a regulatory tipping point

Maine's LD 307 passed 79-62 in the House and 21-13 in the Senate. Gov. Janet Mills has not yet signaled whether she will sign. At least eleven other states are pursuing similar moratoriums, and Sen. Bernie Sanders and Rep. Alexandria Ocasio-Cortez have introduced federal moratorium legislation. Virginia's appeals court invalidated the 22-million-square-foot Digital Gateway rezoning outside Washington, D.C. Kentucky's HB 593, which would have required data centers to cover their own transmission costs and imposed a $75,000 application fee, passed the House 90-8 but died in the Senate after Louisville Gas & Electric and Kentucky Utilities opposed it.

The industry's fragmentation is the core vulnerability. The Artificial Intelligence Infrastructure Coalition, cofounded by former Sen. Kyrsten Sinema and former Rep. Garret Graves, warned developers risk "ceding the public debate to the loudest voices who will regulate them out of existence." Flexential CEO Ryan Mallory conceded the industry "hasn't done a good job of explaining itself." Risk: every jurisdiction that lacks a clear data center regulatory framework is now a moratorium candidate. Developers operating where rules already exist, including Texas with its ERCOT and PUC processes, hold a structural advantage that widens with each statehouse pause.

A $1.4 trillion utility spending wave collides with rate pressure and grid constraints

Fifty-one investor-owned utilities have requested permission to spend $1.4 trillion through 2030, up over 20% from last year, per PowerLines research. U.S. electricity rates are already 5% higher year-over-year. In Louisiana, the Public Service Commission voted 4-1 to fast-track Entergy's application for seven additional gas-fired plants totaling 7,400 MW to serve Meta's $27 billion Richland Parish facility alone, more than half Entergy's current statewide output. A final vote comes in December. Utah faces a similar squeeze: 920 MW of current data center capacity will triple to 3,500 MW as 2,600 MW come under construction, with the North American Electricity Reliability Corporation projecting elevated grid risk there beginning in 2031.

OpenAI's pause on its £31 billion UK Stargate project underscores how power economics sort winners from losers. UK industrial electricity costs £168/MWh versus £38 in Texas. That differential is driving hyperscaler capital toward Texas and the U.S. broadly. Risk: rising residential rates create political backlash that commissioners cannot ignore. Louisiana's expedited "lightning initiative" waived competitive bidding requirements, setting precedent that could draw legal challenge. Developers must prepare for commissions that demand cost-justification and transparency, not just fast approval.

Water

Utah's boom exposes the cooling-versus-consumption tradeoff

Utah's data center corridor on the Wasatch Front sits in an area the World Resources Institute classifies as high baseline water stress, yet nearly all of the state's 48 operational and planned facilities cluster there. Shon Hiatt of USC's Marshall School of Business quantified the problem: AI-grade GPU cooling via evaporative systems consumes roughly 2 million liters daily per 100 MW facility, equivalent to 6,500 households. Forty-three percent of hyperscale facilities using evaporative cooling globally sit in areas of extremely high water stress. Non-evaporative liquid cooling exists but carries 16-18% higher energy consumption.

In Fort Worth, Black Mountain Energy's 187-acre data center proposal advanced through the Zoning Commission on April 8 with claims of closed-loop water recycling, but provided no specific consumption data or third-party validation. Community opposition there centers on cumulative environmental exposure from an adjacent 13-million-square-foot landfill. Risk: water constraints increasingly function as a veto on site selection. Developers who can demonstrate verified water budgets and non-evaporative cooling strategies will clear permitting hurdles that stop competitors cold.
