NERC's Rare Grid Warning Hands Texas Developers an 18-Month Window

NERC just issued its third-ever Level 3 alert, naming datacenter load growth as a grid reliability risk while Denmark pauses connections and Lexington drafts a 50,000-square-foot cap. Texas hasn't moved that direction, and the developers arriving with behind-the-meter generation and water offsets locked, the BaRupOn and Oracle-Bloom playbooks, get an 18-month head start before the political window closes.

NERC issued a Level 3 alert Monday, only the third in the organization's history, warning of "significant risks" to bulk power reliability from large data centers. The trigger: documented disconnection events in Virginia and Texas since 2022, including a Virginia near-miss where nine data centers dropped simultaneously and nearly cascaded into rolling blackouts on recovery.

The alert lays groundwork for mandatory FERC-approved standards on load disclosure, ramp rates, and fault recording. Smart developers should expect rules within 18 months and front-load coordination with transmission operators now.

Power

The grid bypass is now a category, not an exception.

Fleet Data Centers filed April 20 to build 350+ MW of behind-the-meter gas and diesel at Tahoe Reno, with Nvidia reported as anchor tenant on a $3.8 billion bond. Oracle and Bloom Energy are deploying up to 2.45 GW of solid oxide fuel cells for Project Jupiter in Doña Ana County, replacing planned gas turbines and approaching Bloom's entire cumulative deployed capacity. BaRupOn's 700-acre Liberty, Texas campus will self-generate 3 GW from natural gas and recycle rainwater rather than draw ERCOT power or Liberty County aquifers. OpenAI's Abilene site is the Texas template at 0.9 GW, with executives describing 20+ GW near term.

The risk cuts two ways: ERCOT loses queue revenue and wholesale-market participation from the largest load class on the system, while developers who can't execute distributed generation logistics watch competitors clear sites in two years instead of waiting three in queue.

Politics

Elsewhere says no; Texas asks how.

Denmark's Energinet paused new connections with 60 GW queued against 7 GW peak demand. Lexington's planning department is drafting a zoning amendment that would cap data centers at 50,000 square feet countywide, directly contradicting Kentucky HB 775's tier-1 incentive for $450 million projects in Fayette County. Maine Gov. Janet Mills vetoed a moratorium to preserve a $550 million project in Jay; Sanders and Ocasio-Cortez have proposed a federal moratorium; Pew found half of Democrats call data centers "mostly bad" for the environment. The Netherlands and Ireland have already cycled through full moratoriums.

Texas hasn't moved this direction, and the contrast is the opportunity. Developers arriving with self-generation and water offsets locked, the BaRupOn and Oracle-Bloom playbooks, convert the political question from "should we allow this" to "how fast can we permit it." The risk is the inverse: any Texas developer who shows up asking the grid and the aquifer to absorb their footprint imports the Lexington and Maine fights at full strength.

Power

The contracted-vs-operational gap on hyperscaler commitments is widening.

OpenAI claims 10 GW of contracted capacity, but CFO Sarah Friar confirmed just 1.9 GW of compute was actually online at end of 2025. Stargate's cost estimate moved from $500 billion to $600 billion. The company has restructured around cloud leases with AWS, Microsoft, Oracle, and CoreWeave rather than owned greenfield builds. Goldman Sachs separately pegged AI infrastructure capex at $7.6 trillion through 2031, anchored to NVIDIA forward revenue, and flagged that a small number of supply-side assumptions move the headline number.

For Texas, this means OpenAI demand will likely flow through existing hyperscaler ERCOT positions, not new direct site selection. Developers betting on anchor-tenant offtake from generative AI giants should price revenue-conditional language and milestone-tied tranches into every PPA. Announced gigawatts aren't financed gigawatts.
