EPA proposes letting states set public notice and protest rules for the minor-source air permits Texas data centers use; comments close Aug 21

EPA is proposing to hand states the pen on how much notice and public input attaches to permits for "minor" air polluters, the class that covers concrete batch plants and rock crushers and, increasingly, large data centers running diesel generators and certain gas turbines. If the change takes effect, TCEQ gets authority to rewrite its own rules and could scale back the chance to protest or challenge a permit before issuance, though any TCEQ rewrite would run through TCEQ's own rulemaking, where people can give input. EPA holds a virtual public hearing July 22, signup closes July 19, and written comments run through Aug 21.

EPA says the change is "intended to reduce administrative burden and responsibly speed up permitting, supporting American economic development and energy dominance" by putting the state agencies "most familiar with local issues in the driver's seat." EPA spokesperson Carolyn Holran said states will be given the choice to decide what's best for their communities, and that the proposal "does not alter emission standards or weaken environmental protections." Jennifer Hadayia, Executive Director of Air Alliance Houston, reads the same text the other way, warning that TCEQ could respond by adopting its own rules that eliminate the public participation requirements.

Abilene shows the notice gap at street level. Omaira Garcia, an Air Force veteran, told Floodlight she learned of OpenAI's Stargate campus beside her ranch only after construction began in the summer of 2024; a Crusoe spokesperson said the project has "contributed meaningfully to the economic development" of Abilene. Lubbock is having the argument earlier, with more than 1,500 survey responses in hand and Councilwoman Christy Martinez-Garcia saying districts one and two already carry all of the industrial companies, per KCBD reporting relayed by The Cool Down. Fort Worth is further along with four sites operating, and some council members want a temporary pause to study regulations, though those four sites are the reason the city has load and water data to study at all. In each case the argument turns on numbers the operator holds and the public doesn't: load, water source, and generator counts.

Eric Masanet, a sustainability researcher at UC Santa Barbara who studies data centers, told The Atlantic that "we don't have the real ground-truth numbers on data-center water use to put everyone on the same page." Neither operators nor utilities offer much insight, so the same thin record gets read three different ways: OpenAI CEO Sam Altman has called the water issue "totally fake" and "insane," a Pirate Wires piece in December argued the crisis isn't real, and New York Gov. Kathy Hochul's office cited the "massive amounts" of water hyperscale sites could require. In a drought-stricken county or during a heat wave, a data center may seriously burden supply, and that case has to be answered with metered numbers.

QTS and Lancium answered it in advance at Hall County. The Clean Campus plan near Turkey runs more than $10 billion in capital across up to 11 buildings, with both companies funding 100% of the energy infrastructure the site needs. QTS says the campus will run closed-loop cooling and won't draw water from Turkey's municipal supply, and expects to draw all the campus's water from on-site wells or truck it in from approved external sources. Michael McNamara, Founder and CEO of Lancium, framed it as bringing the investment "in a way that benefits the grid." A water record an operator can hand a council before it asks is the same record that carries an air permit through a protest window TCEQ may be about to shorten.

PJM Interconnection's latest long-term auction report reads worse than last year's. The Base Residual Auction for 2028-2029 procured almost 150 GW of capacity, below expectations of what's needed to stay safe through extremely rare peak demand events, and the installed reserve margin two-plus years out lands at 14.4%, nearly 6 points under the 20% target for a one-day-in-10-year peak. PJM's own executive summary says "the RTO, as a whole, failed the market structure test...resulting in the application of market power mitigation to all existing generation capacity resources." PJM balances power across 13 states and close to 67 million people, and the squeeze passes through to customers in Virginia, Maryland, the District of Columbia, Pennsylvania, New Jersey, Michigan, North Carolina, and West Virginia.

Texas operators built around that problem years ago. Iren, once the Bitcoin miner Iris Energy, owns as much of the chain as it can: two Sweetwater sites planned to reach 2 GW with operations starting this year, 1.6 GW in Oklahoma from 2028, 750 MW running in Childress, and 160 MW of air-cooled capacity across three British Columbia sites. Chief Commercial Officer Kent Draper says the company is "sitting on a very large amount of secure power and land," and that being vertically integrated is "a pretty big difference versus your Nebiuses and CoreWeaves." Every megawatt an operator self-supplies with turbines or generators clears through a minor-source air permit instead of a capacity auction, which is why the TCEQ rewrite is the schedule risk to watch.

New York froze state permits at 50 MW or more because it had no record to judge them against

New York is the first state to answer data center growth by stopping it, and the scope is narrower than the coverage suggests. Gov. Kathy Hochul's executive order directs the Department of Environmental Conservation to pause applications for discretionary state permits for construction or expansion of data centers consuming 50 MW or more, unless the application was already deemed complete before the order took effect. Local government permits aren't affected at all, and the pause runs until the state completes a Generic Environmental Impact Statement or one year, whichever comes first.

The order's machinery sits inside an existing interconnection proceeding. It expands a Public Service Commission case on large-load interconnection reforms instead of launching a new one, with the Department of Public Service preparing the impact statement through PSC Case 26-E-0045 and Empire State Development given 60 days to publish a Community Investment Framework for benefits agreements. That's a state improvising the review Texas operators have been filing into for years, and the freeze is what it costs when the machinery arrives after nearly 12 GW of load is already in the NYISO queue, over 8 GW of it during 2025. Texas runs the opposite way, where the minor-source permit is a form an operator files, and the operators who file a complete air record at the front end give a freeze no premise to reach them.
