In Texas the data-center question dropped from the Capitol to city halls, and water disclosure is becoming the price of local consent.

Hut 8 fully commercialized its 1-gigawatt Beacon Point campus with a $9.8 billion lease today, while Austin's council takes up water-disclosure rules Thursday. The Texas data-center debate has moved to local government, and the strongest operators are already volunteering the disclosure others now want on paper.

The Texas data-center story ran through the Capitol last session; this week it runs through a city council chamber and a county civic center. On Monday, Hut 8 signed a second 15-year lease worth $9.8 billion with an investment-grade customer, fully commercializing its 1-gigawatt Beacon Point campus in Texas. On Thursday, the Austin City Council is set to discuss a resolution that would ask the heaviest water users to create conservation plans and drop some non-disclosure practices. In the fastest-growing data-center market in the country, disclosing how much water you draw is becoming the price of local consent, and the strongest operators are already volunteering it.

The debate that once ran through Austin now fills the Hereford Civic Center

Hundreds of Deaf Smith County residents packed the Hereford Civic Center to press Google, Intersect, and Blattner on Project Roman, a Google-operated data center planned on 3,700 acres 22 miles north of Hereford. Intersect has acquired adjacent land for a solar and wind farm to power it. The biggest concern raised was water use.

County Judge DJ Wagner said the county worked with hydrologists and put safeguards in place, describing "a closed-loop system" that would use the Santa Rosa aquifer "in lieu of the Ogallala Aquifer." The project is expected to bring 2,500 construction jobs and 90 permanent jobs, and Junie Wagner, executive director of the local chamber of commerce, backed it: "you want growth in your community, because if you don't grow, you die or you get stagnant." The venue has changed, and the operators who bring hydrology answers to the civic center are the ones who hold the room.

Power

In West Texas, a 2.7-gigawatt power deal skips the utility

Microsoft's AI data center in West Texas is installing 2.7 gigawatts of natural gas turbines from GE Vernova, fed directly by Chevron under a 20-year contract that bypasses local electric utilities. Chevron's president of new energies, Jeff Gustavson, signaled more deals like it: "If we can get to a returns equation that works for our company and our shareholders, you can expect to hear more from us going forward."

Bringing your own power is the supply-side version of bringing your own water plan: it takes the strain off the local grid the way a closed-loop design takes it off the aquifer. Power is one of four supply-chain chokepoints tightening across the industry, alongside AI accelerators, memory, and optics, and technology consultant Geoff Tate said "the worst one will gate demand for all the others." That's why contracted power now travels with the lease, with Hut 8's 949 MW of contracted AI capacity backed by 1,330 MW of utility capacity, all tied to investment-grade counterparties.

Water

Disclosure is becoming the cost of a water connection

Austin's resolution, up for discussion Thursday, asks City Manager T.C. Broadnax to create an application process for customers requiring more than 85 million gallons of water per year. The application may require large water users to adopt conservation strategies such as connecting to reclaimed water systems or using their own closed-loop cooling, and it would end some non-disclosure practices. Mayor Kirk Watson and four council members prompted it as Austin joins a growing number of Texas local governments weighing responses.

What Austin would codify, the best operators already offer. In Deaf Smith County, the closed-loop design presented for the Google project came before any mandate required it. The cautionary tales sit in other states: Oklahoma data centers buy municipal water with no permit and go largely untracked, and the state water board's Julie Cunningham noted they "do not get a permit." In Wyoming, Cheyenne traced a dangerous bacterium to a Meta data-center contractor and permanently terminated its discharge privileges. Texas is writing down what good operators already do.

The backlash next door keeps routing capital to Texas

Opponents held 142 protests across 42 states on Saturday, the first nationwide effort, coordinated by HumansFirst, a group co-founded by former Tea Party leader Amy Kremer. Add a New York state-level permitting pause and a Palm Beach County rejection, and the picture looks like resistance. The capital flows tell a different story. A Washington Examiner op-ed, citing Bloomberg, argued that blanket moratoriums "discourage investment and drive projects to jurisdictions with more predictable regulatory environments," with Texas first among them, as 12 states weigh such measures and at least 54 local bans sit on the books.

Even the states cooling on bans are converging on guardrails and disclosure. Michigan Governor Gretchen Whitmer opposes a statewide moratorium and instead pitched consumer rate protections and a voluntary company pledge to cover costs and follow state water and energy rules. Data Center Coalition president Josh Levi said the industry keeps working with policymakers and residents so that data centers "strengthen, not strain, the areas where they operate." The national mood is the wind at Texas's back, and Beacon Point's fresh $9.8 billion lease is where it lands.
