Gov. Abbott's Audit Leaves Batch Zero With No Restart Date

ERCOT just froze the most time-critical large-load batch in its queue. On August 10 it filed for good-cause exceptions in PUCT Control No. 58317, telling the Public Utility Commission of Texas it will blow past its own Batch Zero deadlines because Governor Greg Abbott’s August 3 audit order requires months of verification before studies can restart.

The operator is pausing the transitional large-load study process for data centers and other computational loads 25 MW or larger that have not energized, including virtual currency mining. Quarterly stability assessments that gate later interconnection stages can’t run on schedule, and ERCOT will brief the Commission on compliance plans at the August 14 open meeting. Developers already posted in Batch Zero now carry capital between filed requests and the first stability gate with no restart date on the filing.

Out-of-state policy is tightening around process, not just siting. New York imposed a statewide yearlong ban on hyperscale data centers in July, the first state-level freeze of that kind in the digests. Opposition groups from Missouri to New Mexico to Virginia are shifting from harm arguments to procedural suits over notice, zoning, and meeting rules, a track Data Center Watch tied to at least 75 projects stalled in the first three months of 2024; Blackstone’s QTS and Compass abandoned a Prince William County, Virginia conversion after a state court faulted public notice.

On the Eastern Interconnection, more than 3 GW of data center load dropped off PJM on July 22, 2026 after a single transmission fault near Ashburn, repeating a failure mode NERC investigated when 1.5 GW shed on July 10, 2024. Customer-side protection, static switches, UPS logic, and counting relays uncoordinated with utility reclosing, drove the trips. Standards drafting on those settings is coming; operators who file engineering-grade coordination testimony will shape the obligation, and those who don’t will inherit it.

ERCOT’s exception request under 16 TAC 25.3(b) seeks relief from Planning Guide sections 5 and 9 on QSAs and Batch Zero deadlines. Without the grant, the operator faces a direct collision between the Governor’s directive and its interconnection calendar. Chad V. Seely, ERCOT SVP of Regulatory Policy and General Counsel, signed the filing; the verification will also force community-impact data from every affected developer before studies resume.

Projects already energized or deep in construction sit outside the freeze. Tesla’s Cortex 2 at Giga Texas, with a first 250 MW phase live in April 2026 and onsite AI compute more than doubling in the first half of 2026, keeps moving because it is not a speculative queue entry. Fermi Inc. reset its narrative with a binding $6.5B, 15-year lease to TensorWave for 222 MW at Project Matador in Carson County, phased from 2H 2027, with expansion rights toward 650-plus MW still uncommitted and still subject to project financing and third-party guarantees.

Behind-the-meter buildout is the bridge operators are buying while the queue is stuck. Amazon’s GW Ranch campus in Pecos County pairs the load with a dedicated 7.65 GW natural gas plant from Pacifico Energy, permitted to run disconnected from ERCOT at first and “designed to transition to grid-connected service as interconnection timelines allow,” with the company stating it will pay full power costs and not raise household bills. J.P. Morgan puts 2026 hyperscaler capex at $697 billion and already originated $9.6B across two construction loans for Project Stargate’s Abilene campus, proof capital is still clearing Texas when generation and tenants are real.

Bottom line: treat the pause as a planning window to lock anchor tenants, self-supplied power, and clean interconnection files before Batch Zero reopens; carrying cost compounds every quarter the QSA gate stays shut.

Sierra Club Lone Star Chapter filed August 10 comments in PUCT Control No. 58000 Item 20 for about 350 Texas members backing staff’s plan to push more transmission cost onto large users. The package would replace 4CP with a 12-month, 30-minute year-round measure, add dedicated demand tariffs, and make large users fund interconnection, upgrades, and security. The Club wants the trigger cut from 75 MW to 25 MW, a band that would pull many emerging campuses into the redesign and force fresh underwriting on deposits and tariffs.

Governor Greg Abbott’s June 10 direction already told the PUCT and ERCOT to make data centers fully fund electric infrastructure serving them, and he pledged 2027 work on generation-addition rules, closed-loop or water-efficient cooling, annual power and water reporting, community-impact standards, and repeal of sales-tax exemptions on equipment, power gear, electricity, and fuel. KFDM cites a Comptroller-linked $3.2B two-year sales-tax shortfall tied to the 2013 exemption, with at least $1.3B forgone expected this year. OpenAI, Meta, Amazon, Google, QTS, Skybox, Digital Realty, and MARA have been cited as aligning with his standards; Diode withdrew near Cedar Creek Lake after it did not meet them.

Binding force still tracks ERCOT geography. Meta’s $14 billion Northeast El Paso project keeps its full 2023 package, valued locally at $550 million including an 80% property-tax break for 25 years plus $12.5M in city road funds, because El Paso Electric sits outside ERCOT and city-county deals were not amended. At least 34 Texas counties have petitioned for mandatory disclosure rules. Shell companies, NDAs, and post-land-acquisition outreach (Crusoe’s stated sequence in Abilene) are feeding county and resident pushback in Grayson, Hood, and elsewhere; Texas Tribune and San Antonio Current both flag early voluntary disclosure as the path that compresses permits instead of inviting process fights.

Bottom line: model full infrastructure funding, a possible 25 MW cost-allocation floor, and audit-ready community-impact files now; the operators who show up in 58000 and local hearings write the terms everyone else prices later.

Water is no longer a secondary diligence item in Texas large-load review. Abbott’s framework calls for closed-loop or water-efficient cooling, reuse instead of public-supply draw, and annual water-consumption reporting alongside power data, and the ERCOT audit now demands water figures before pending interconnections advance. Non-compliance risks denial of approval under the verification order.

Amazon’s Pecos plan uses brackish groundwater unsuitable for irrigation or drinking, a site-level offset to freshwater fight risk. Hood County drew a developer suit after rejecting a concept plan for insufficient water-source documentation, a live example of local process stopping a file when water proof is thin. Skybox’s PowerCampus Austin in Hutto, a 600 MW, 4-million-square-foot campus on 160 acres designed around an onsite privately owned Oncor substation, sits in the same policy window where cooling design and consumption disclosure will be checked against the new expectations before tax and interconnection assumptions hold.

Bottom line: lock closed-loop or brackish design, meter plans, and public water offsets before the next local hearing or audit notice; missing water proof is now a queue and permit stopper, not a design footnote.
