1,100 Acres Enter Site Work Before Cameron Names Load or Tenant

Fluidstack's $4B Cameron build just hit site work across 1,100 acres while ERCOT's Batch Zero path still gates 191.8 GW. Developers who lock private generation and water offsets before county hearings keep schedules that don't survive the pauses stacking outside Texas.

Fluidstack has started site work on a $4B first phase spanning 1,100 acres in unincorporated Cameron County near Rio Hondo after a September 10 worksite permit. The New York developer targets mid-2028 completion and more than 2,500 construction jobs, east of FM 509 and west of FM 106, adjacent to Valley International Airport.

The permit covers clearing, grading, utilities, stormwater, and retention ponds only, not buildings. County Judge Eddie Treviño Jr. called it ministerial compliance, not endorsement, while load size and anchor tenant remain undisclosed, leaving the ERCOT path opaque under SB 6 and Governor Greg Abbott's August 3 interconnection audit directive.

Out-of-state policy pressure is live and local. These are cautionary site-selection signals. Capital still concentrates where interconnection, water baselines, and local authority line up before the first council hearing.

Batch Zero gates and private generation move first

ERCOT released conditional classifications for 362 large loads totaling 191.8 GW under Batch Zero, with most not-yet-energized loads tied to PGRR 145 verification, model cures, and nine good-cause exceptions still open. Synergen Green Energy filed a good-cause exception in PUCT Control No. 59142, Item 57, after missing July 10 and July 24 eligibility dates; the firm cites $31M already spent on a 300 MW Calhoun County ammonia project and a financial-security hit near $15M that the compressed post-approval window made impractical.

Private generation is no longer bridge kit. Panelists at the Data Center Frontier Trends Summit put onsite stacks in the front seat as interconnection and equipment queues lag AI build schedules, while Applied Digital signed a $2B design-build with Base Electron for 1.2 GW of boiler-steam capacity across three North Dakota campuses, with first operations targeted late 2028 as gas-turbine lead times stretch toward 2032. Volta Foundation's AI committee finds BESS competitive on peak shaving and queue bridge power, then loses beyond four-hour duration and continuous prime power to gas, diesel, and fuel cells, with integration and dispatch standards still unsettled in the first two operating years.

Bottom line: lock generation sequencing, Batch Zero verification posture, and dispute path (Protocols Sec. 20 or Planning Guide 9.3.1) before posting the next tranche of security.

Cooling design and aquifer fights now gate permits

Cameron County's April 2026 resolution requires protections on water supply, drainage, and roads and specifically opposes open-loop evaporative cooling that consumes potable water; Precinct 3 Commissioner David A. Garza said Fluidstack is "doing it right," which sets the bar other South Texas filings will meet. Amazon's withdrawal of its King George County, Virginia aquifer bid shows how fast depletion optics collapse a groundwater path once neighbors organize.

Boiler-steam self-supply shortens power waits but raises intake and cooling demand that must be offset before site control, not after the worksite permit. Operators still designing around open towers or unsecured groundwater carry stranded-asset and re-permit risk inside the same audit window Governor Greg Abbott already opened on large loads.

Bottom line: finish water-offset verification and closed-loop design packages before the first county hearing.

Local vetoes and a Railroad Commission race set the next six years

Iowa's Decision Tool and Georgia's stacked local pauses show communities baselining water, grid, and benefit-sharing before approvals, while Nevada counties note they were left out of the state tax-break review even as Storey County already conditions abatements on public-cost offsets. Oracle's New Mexico stack still depends on state land commissioner ROW decisions and court pauses that federal pipeline speed on BLM land can't override.

In Texas, Democratic state Rep. Jon Rosenthal, a mechanical engineer and House Energy Resources Committee member, faces Republican nominee Bo French for the Railroad Commission seat vacated by Jim Wright in the November 3 general election. A Rosenthal win would put one Democrat on a three-member body still holding Republican majorities through Chairman Christi Craddick and Wayne Christian's staggered terms, with drilling, pipeline, and disposal permits in the middle of every gas-fired and behind-the-meter plan.

Bottom line: map county veto posture and RRC race outcomes into site schedules now; carrying cost accrues while those seats and ordinances move without the load in the room.
