Texas Developers Need No Permission. Rural Counties Are Changing That.

Wise County's Commissioners Court voted unanimously to demand state oversight of datacenter siting, joining Hood, Somervell, and Jack counties in a coordinated push after 90 residents packed a public hearing and developer Ryan Hughes told commissioners he doesn't need their permission to build. There's no regular legislative session until January 2027, so until Austin acts, that political friction is the only permitting risk that's real.

Rural Texas counties are pushing back hard against datacenter development they can't control. Wise County's Commissioners Court unanimously passed a resolution Monday demanding the Texas Legislature either regulate datacenter siting statewide or grant counties explicit authority over projects in unincorporated areas, where developers can currently begin construction without even notifying the county. The resolution, sent to Governor Abbott, Lt. Gov. Patrick, the PUCT, ERCOT, and the Texas Water Development Board, follows a public hearing that drew roughly 90 residents and reflects a pattern now visible across Hood County, Somervell County, and Jack County simultaneously. With the next regular legislative session not until January 2027, counties face a long wait unless the Governor calls a special session.

Rural Texas Regulatory Vacuum Is the Biggest Near-Term Risk to Datacenter Permitting

The Wise County resolution is part of a broader pattern. Hood County, southwest of Fort Worth, has at least six datacenter projects in its pipeline, including the Comanche Circle development with more than 30 buildings, each roughly 2.5 times the size of a Walmart. Developer Ryan Hughes of Sailfish Investors asserted at a commissioners meeting that without zoning authority, he has every right to build. Residents Brad Davis and Brian Crawford are fighting back, citing cumulative impacts from projects spanning Hood and Somervell counties.

Wise County Judge J.D. Clark explicitly hopes other counties will pass similar resolutions to build collective pressure. The strategy is clear: create enough political mass to force state action.

Pennsylvania offers a contrast worth watching. Two bills recently cleared the Pennsylvania House Energy Committee requiring large datacenters to disclose annual energy and water consumption and establishing model local ordinances for municipal siting control. That legislation passed along party lines, with Republicans arguing it risks making the state uncompetitive.

Bottom line: Texas counties currently have zero authority to stop or shape datacenter siting on private land absent subdivision or tax incentive requests. Until the Legislature acts, rural opposition will grow louder, and developers face escalating political risk in counties that feel blindsided. Could a coalition of counties create enough friction to slow site selection even without formal authority? That's the question to watch.

Water

Arizona Provides a Model, but Texas Faces a Wider Range of Unknowns

Arizona's datacenter water consumption turns out to be far less alarming than feared. A Ceres analysis estimated active Phoenix-area datacenters consumed roughly 385 million gallons annually last summer. Even a tenfold increase to 3.8 billion gallons would represent less than 0.5% of total regional water usage. Arizona State University's Sarah Porter put it plainly: "There's not a hair-on-fire context right now."

Texas doesn't have that reassurance yet. CBS News cites a study estimating Texas datacenter water consumption could range between 29 billion and 161 billion gallons annually by 2030, a massive spread that reflects deep uncertainty about cooling technology choices and build-out pace.

Internationally, Thailand's Eastern Economic Corridor offers a cautionary tale. Two-thirds of Thailand's 70-plus datacenter projects are concentrated in three provinces already battling water shortages and industrial pollution. Crab farmer Sarayuth Sonlacksa fears a new Chonburi datacenter will trigger "more water conflict, with more competition for resources."

Bottom line: Arizona's experience suggests datacenter water demand can be managed relative to total regional consumption, but only with transparency on actual usage. Texas lacks that data. Until operators disclose consumption and regulators establish clear water rights frameworks, the 29-to-161 billion gallon range is a planning nightmare, not a planning tool.

Power

Gas Turbine Shortages and Solar Politics Collide on Build-Out Timelines

Texas leads national natural gas consumption for electricity by a nearly 2-to-1 margin, and the state accounts for 80.6 GW of the 252 GW national gas-fired development pipeline, according to Energy News Beat. Some 40 GW is specifically earmarked for datacenters. But turbine backlogs now stretch to 2029-2030, creating real delivery risk.

Solar remains the quickest path to new generation — one to two years versus five to ten for gas — but installations dropped 14% year-over-year following federal incentive rollbacks, per PBS. Craig Courter, former CEO of San Miguel Electric Cooperative near Christine, Texas, secured a $1.4 billion federal loan to replace a lignite coal plant with 400 MW of solar and 200 MW of battery storage. That project remains on track despite political headwinds.

Meanwhile, Europe is sidestepping the grid entirely. Pure Data Centre Group brought a 110 MW islanded datacenter online outside Dublin, running on its own microgrid. Ireland's moratorium on grid-connected facilities forced the move.

Bottom line: operators who can't wait for gas turbines and won't bet on solar's political durability are going to chase microgrids and behind-the-meter generation. Texas's ERCOT batch study process, targeting June 1 Board approval for interconnection protocols, will determine whether grid-connected paths can compete with self-supply timelines.

Community Noise Complaints Are the Sleeper Risk for On-Site Generation

Trump's December pledge getting tech giants to "build, bring, or buy" their own power solves the ratepayer cost problem but creates a new one. In Sterling, Virginia, residents living 100 meters from a Vantage Data Centers facility with eight natural gas turbines report constant high-pitched noise that's made outdoor living unusable. Democratic Rep. Suhas Subramanyam says he receives more constituent complaints about that one site than any other in Loudoun County.

Vantage Vice President of Public Policy John Stephenson acknowledged the complaint but said the operations team detected no "abnormalities." The Data Center Coalition trade group didn't respond to questions about industry noise mitigation practices.

Sen. Bernie Sanders has proposed a nationwide temporary moratorium on new datacenter construction. An opinion piece from the International Data Center Authority's head counters that even a temporary pause risks U.S. competitive standing, citing Loudoun County's transformation into one of America's wealthiest local economies with over $1 billion annually flowing to local schools from datacenter tax revenue.

Bottom line: as Texas operators pursue distributed on-site gas generation to avoid ERCOT interconnection queues, they should expect Virginia-style noise fights to follow. Permitting resistance from neighbors could slow siting approvals even in industrial zones, especially in counties already feeling blindsided by the pace of development.
