JLL's 2026 Global Data Center Outlook confirms the pressure: global capacity will nearly double to 200 GW by 2030, requiring $3 trillion in investment, with grid connection delays averaging four years as the most critical U.S. chokepoint. Equipment lead times have surged 50% from pre-2020 levels to 33 weeks globally. Developers without locked-in storage and generation capacity face project delays that competitors with long-duration storage secured early will avoid.

The bill still requires Senate passage and the governor's signature.

President Trump's Ratepayer Protection Pledge, signed by seven leading hyperscalers, carries no legal enforcement mechanism but declares ratepayer protection "national policy," giving state regulators and community intervenors a new standard to cite in rate proceedings. In Wisconsin, MISO reversed a $350 million substation award from Blackstone-backed Viridon to incumbent American Transmission Company after a $15 billion data center campus created urgency, a decision that shifts cost allocation from multistate ratepayers to Wisconsin customers alone. The pattern is consistent across jurisdictions: developers who model full infrastructure cost internalization from day one will clear approvals faster. Those assuming ratepayer subsidies face mounting political and regulatory exposure.

Texas projects advance through community friction

Fermi America secured final TCEQ approval for Project Matador near Amarillo, the agency's second-largest clean air permit authorizing 23.5 million tons of annual greenhouse gas emissions for the proposed 11 GW, 6,000-acre campus. In Joliet, Illinois, a $20 billion PowerHouse Hillwood campus cleared a six-hour public hearing and city council vote, but vocal residents remain. The risk for Texas developers: permit approvals secured without genuine community partnership create political vulnerabilities that compound over multi-phase, multi-year buildouts.
