December 10 Risks Grid Denial for 250 Projects

Governor Greg Abbott’s audit now carries a denial date. ERCOT delivers the Batch Zero Eligibility Verification Report and Community Impact Review by December 10, with findings at the Public Utility Commission of Texas open meeting on December 17. Non-response risks grid-connection denial for roughly 250 to 300 mature projects while about 474 GW of large-load demand sits on file. That’s carrying cost you can calendar.

December 10 Sorts Who Energizes

ERCOT President and CEO Pablo Vegas told lawmakers Batch Zero won’t launch in September; it’s slipped toward year-end. Only about 205 GW cleared the initial review set. Thu shows PowerHouse already posted $72.5M in security and is asking the PUCT under Control No. 59142 to keep two projects inside the cohort after study-approval timing cut them out.

The earlier gate is already working. Mon put Meta and Rowan Digital Infrastructure on the compliant side in Temple, while Diode withdrew Henderson County rather than clear power, water, and incentive disclosure. Wed moved verification ahead of technical studies after Aug. 20. RFIs run through September; cure windows close in October-November. If your package can’t answer ownership, water offsets, and community mitigation by December 10, you’re funding land through the next study cycle. That’s quarters of carrying cost against a missed batch.

Self-Supplied Power Protects the COD

Fully off-grid and behind-the-meter campuses sit outside the freeze. Fri advances a 2.5 GW Reeves County campus with Phase 1 at 1.5 GW and first power targeted for 2027, fed dual-fuel from Istmo’s fractionation plant so it never enters the ERCOT queue. CleanView already puts Texas at 40 GW of announced behind-the-meter capacity.

The competitive bar moved too. Tue packages generation, private wires, and closed-loop cooling as one $37B bid with ratepayers carrying zero upgrade cost. Operators who don’t lock gas laterals, BTM capacity, or firm PPAs before foundation work budget the six-month slips Oracle just ate on Project Jupiter’s New Mexico fuel path. Texas contrast holds: Energy Transfer already serves Abilene, and Amazon’s Pecos GW Ranch still prices self-supply and a future grid filing as parallel paths before Q1 2027 first power.

Water and Local Consent Sit in the Same Binder

Abbott’s standards put source, reuse, and offset math on the same seniority as the PPA. TCEQ still doesn’t require consumption disclosure on permit apps; TWDB surveys only existing sites at a 29% response rate. Sat makes empty water fields a denial risk when verification lands. At least 100 Texas municipalities have filed data-center ordinances since July 2025. Show up with transmission cost responsibility and a conditions package counties can defend, or the audit calendar writes the defaults without your filing.
